Marin Superior Court Rules in Favor of Marin General Hospital’s Injunction Against Local 39
GREENBRAE, CA, February 8, 2019 – Marin General Hospital today announced Marin Superior Court has ruled in favor of the Hospital regarding its injunction against International Union of Operating Engineers, Local 39. Judge Stephen P. Freccero found “unlawful acts had been committed” by Local 39, whose strike activity and disturbances of patient care and public access to the hospital have been taking place outside the hospital since Friday, February 1, 2019.
In the ruling, the Judge Freccero found that Local 39 was unlawful “specifically to the ongoing proper administration of the hospital and health, safety and welfare of its patients.”
The Judge further ordered Local 39 to refrain from the following activities:
- “…interfering, delaying, or blocking ingress and egress to hospital entrances, driveways, 6 parking lots and structures;”
- “creating, or causing to be created, any excessive noise, including but limited to the use of above described "gongs," that exceeds the following exterior sound level in decibels as measured on a sound level meter using the A-weighted network (the level so read is designated dB(a) or dBA): 7:00 AM – 7:00 PM 50 dB(a) and 7:00 PM to 7:00 AM 40 dB(a)…”
- “…assisting or directing others to take any of the actions” described above
Marin General Hospital respects the right of Local 39 to engage in lawful strike related activities. Further, the hospital remains committed to making every reasonable effort to reach an agreement with the union.
